Terms of Service

1. Acceptance of Terms

By accessing or using SplashRoute ("the Service"), operated by Palms AI, LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SplashRoute is a scheduling, route optimization, and customer-communication platform designed for pool service businesses. The Service includes appointment management, team management, customer management, invoicing, email notifications to your customers, and related tools.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account.

4. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Service; (c) interfere with or disrupt the Service; (d) copy, modify, or distribute any part of the Service without our written consent.

4a. Customer Communications

SplashRoute sends customer notifications by email — appointment confirmations, service reports, receipts, and notices that a visit has moved or been skipped. The Service does not send text messages to your customers on your behalf, and SplashRoute does not operate an SMS campaign. You agree that:

  • You have a legitimate business relationship with each customer whose email address you enter, and you will not import addresses from purchased or scraped lists.
  • Email is used only for transactional service notifications tied to a specific appointment or invoice. No marketing, promotional, political, fundraising, or survey messages are sent to your customers through the Service.
  • If a customer asks you to stop contacting them, you will deactivate or remove them in SplashRoute promptly so the Service stops emailing them.
  • Some features open a draft text message in your own phone's messaging app, pre-filled for you to review and send yourself (for example, letting a customer know a tech is on the way). Those messages are sent by you from your own number, not by SplashRoute, and you are responsible for them.
  • Violation of these terms may result in suspension or termination of your SplashRoute subscription.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

6. Intellectual Property

The Service, including its design, code, features, and branding (including "SplashRoute" and "PalmsAI"), are the intellectual property of Palms AI, LLC and are protected by copyright, trademark, and other intellectual property laws.

7. Subscription and Billing

SplashRoute is a paid subscription. Plans are billed in advance on a recurring basis — monthly plans each month, annual plans each year — to the payment method you provide at checkout, and renew automatically at the then-current price until you cancel. The price and billing interval shown at checkout are the terms that apply to your subscription.

Crew limits. Each plan includes a set number of crews, shown at checkout. Adding crews beyond your plan's limit requires upgrading or adding paid crew capacity. If you move to a plan with a lower limit, you must reduce your active crews to match it.

Cancellation. You may cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period; your data stays accessible until then, and you keep access for the period you have already paid for.

Refunds. Payments already made are non-refundable except where required by law, and we do not pro-rate partial periods. If you believe you were billed in error, contact us and we will review it.

Price changes. We may change prices for future billing periods. We will give you at least 30 days' notice by email before a price change takes effect on your subscription, and you may cancel before it does.

Failed payments. If a payment fails we may retry it and may suspend access until the balance is settled.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, Palms AI, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Privacy Policy

1. Information We Collect

We collect information you provide directly: account information (name, email, password), business information (business name, phone, address), and operational data your business enters (client lists, appointments, team members, invoices, and photos your techs attach to jobs).

Contacts: if you choose to import customers from your device's contacts, the app reads only the contacts involved in that import (read-only access, only when you start an import) — the imported names, phone numbers, and email addresses become customer records in your account. We never access your contacts otherwise.

Location: SplashRoute never tracks your location in the background. If your business turns on arrival verification, the app records a single location reading at the moment a crew member taps Clock In at a job — to confirm the crew arrived at the customer's property — using only the device's foreground ("while using the app") location permission, which you can decline. When arrival verification is off, or permission is declined, no location is collected. Customer addresses you type in are geocoded (converted to map coordinates) so routes can be planned — see Data Sharing below.

2. How We Use Your Information

We use your information to: (a) provide and maintain the Service; (b) process appointments and scheduling; (c) send appointment and service emails to your customers on your behalf; (d) create invoices and process card payments you initiate; (e) if your business enables arrival verification, record a foreground location reading at Clock In to confirm the crew reached the job; (f) improve the Service; (g) communicate with you about the Service.

3. Data Storage and Security

Your data is stored securely using industry-standard encryption and access controls. We use Supabase for database hosting with row-level security to ensure your business data is isolated from other users.

4. Data Sharing

We never sell your data. We share it only with the service providers that run the Service, each for the single purpose listed: Supabase (database hosting and authentication), Stripe (payment processing), Loops (transactional email — the confirmations, service reports, receipts, and account notices the Service sends), Vercel (application hosting), Mapbox (geocoding the addresses you enter so routes can be planned), Intuit QuickBooks (accounting sync — only if your business chooses to connect QuickBooks), and Sentry (error diagnostics, so we can find and fix crashes — reports are automatically scrubbed of personal data such as names, emails, and phone numbers before they are sent). We may also disclose data when required by law or legal process.

5. Your Client Data

Client information you enter (names, addresses, phone numbers) is your business data. You are responsible for ensuring you have appropriate consent to store and use your clients' information. We process this data only to provide the Service to you.

6. Customer Email Communications

SplashRoute (Palms AI, LLC) sends transactional emails to your customers on your behalf — appointment confirmations, service reports, receipts, and notices that a visit has moved or been skipped — through our email provider, Loops. These emails carry your business name and your reply-to address, so a customer replying reaches you directly. Email frequency varies by appointment activity (typically one to three emails per appointment). Customer email addresses are used solely to deliver these service notifications and are never sold or shared with third parties for their own marketing. We do not send marketing email to your customers. SplashRoute does not send text messages to your customers; where the app offers to text a customer, it opens a draft in your own phone's messaging app for you to send yourself.

7. Data Retention and Deletion

We retain your data for as long as your account is active. You can request deletion of your account and data at any time — in the app or on our account deletion page. Deletion requests are processed within 30 days, after which your data is permanently removed. For business owners, this includes the business's data (customers, appointments, invoices, and message history).

8. Your Rights

You have the right to: (a) access your data; (b) correct inaccurate data; (c) export your data (CSV export is available); (d) delete your account and data (see our account deletion page); (e) opt out of non-essential communications.

9. Cookies

We use essential cookies for authentication and session management. We do not use tracking cookies or third-party advertising cookies.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes via email or in-app notification.
